Are you an obliged entity? Accountants and tax advisers

Auditors, external accountants, tax advisers and anyone who provides material aid, assistance or advice on tax matters as their main business or professional activity are obliged entities (Art. 2.1.m). If you also form companies for clients, Art. 2.1.o applies too. If your firm is covered, you must identify customers, apply due diligence, screen them and keep the documentation — and directors can be held personally liable for infringements (Art. 54).

AML obligations for advisory firms: the cost of having no system

SEPBLAC may inspect you and ask for the file of any customer (Art. 47). Serious infringements carry fines from €60,000 (Art. 57), and liability can fall personally on the firm’s partners or directors (Art. 54).

Fines from €60,000

Failings in identification, due diligence or record keeping can amount to serious infringements, with a minimum fine of €60,000 (Art. 57).

Directors’ liability

Sanctions can fall personally on the firm’s partner or director, not just on the company (Art. 54).

SEPBLAC inspections

SEPBLAC may ask for the AML file of any customer (Art. 47). Without a traceable due diligence record, an inspection is a direct risk.

Company structures and beneficial owner

If you help set up companies or manage third-party funds, you must identify the beneficial owner (Art. 4) and screen the parties involved.

What the software automates and what remains yours

SimplifiAML covers the repetitive part of AML — screening, records and documentation for every customer — so your team does not depend on manual processes or consultants for each case. It does not replace your professional judgement or the organisational obligations the law may impose on you.

What the software automates

  • ✓Periodic and on-demand screening against sanctions lists, PEPs and close associates
  • ✓Structured record of customers, beneficial owner and due diligence decisions
  • ✓Digital customer files, exportable for inspection
  • ✓Alerts on list changes or configured risk signals

What remains yours

  • →Deciding the level of due diligence and reporting to SEPBLAC
  • →The prevention manual, the representative to SEPBLAC and internal training, where applicable
  • →Reviews or examinations by an independent external expert, where the law requires them
  • →Final responsibility as an obliged entity and as a professional
